You should have a look at the beam in your own eye, because last July 11, during a bombing, the terrorists of the State, firing from miles away, killed 14 guerrillas in the village of La Loma Murry, municipality of Vig?a del Fuerte, Antioquia department. There were no condolences for them. They also had families, they were also human beings of flesh and blood, they were also Colombians.

Comprehensive rights of victims for peace and national reconciliation

In order to advance in the discussion on item 5, Victims, as derived from the conceptual framework set out in the documents entitled "Our commitment to the victims of the conflict and their rights" and "Victimization by the regime against political alternatives and ordinary people", the FARC-EP present 10 minimum proposals, also inspired by the "DECLARATION OF PRINCIPLES FOR THE DISCUSSION OF AGENDA ITEM 5: "VICTIMS".

1. Clarification of the historical truth of the conflict and its impact on the population.
2. Recognition of the victims of the conflict.
3. Special recognition of collective victims; political and social organizations, trade unions and peasant and afro-descendant communities, and indigenous peoples.
4. Systemic responsibility, primary responsibility of the state and multiple responsibilities, including responsibilities of the guerrilla, towards the victims of the conflict.
5. Full recognition and real and effective materialization of the rights of the victims of the conflict, with particular attention to women's rights.
6. Full compensation for the victims of conflict and creation of the Special Fund for Comprehensive Compensation (FERI).
7. Direct participation of the victims of the conflict and their organizations in the definition of policies for the effective protection of their rights.
8. Agreed definition of legal mechanisms and tools to ensure the rights of the victims of the conflict.
9. Provision of real and material guarantees of non-repetition.
10. Political and social pardon as a foundation for a national reconciliation process.

We will develop some aspects of the first proposal below.

1. Clarification of the historical truth of the conflict and its impact on the population.
The necessary conditions to clarify the historical truth of the conflict and its victims will be provided. This purpose is a prerequisite for the construction of an eventual Final Agreement. The FARC-EP feels deeply committed to the truth, not only because of the counterfeiting of the history of the conflict and the attempt of creating an official history of victors (which hasn't been the case), but primarily because it is a requirement of the society as a whole and especially of those who have been victims. In this regard, we took the initiative to create the "Historical Commission of the conflict and its victims," ??composed of recognized experts and social researchers, who independently will present a report to society and victims, that should contribute to clarifying the origins and causes of the conflict, the main factors and conditions that have facilitated or contributed to the persistence of the conflict and the most notorious effects and impacts of the conflict on the population.

We demand the creation of a Truth Commission, of independent nature, with full autonomy in the exercise of their work. Its work must:

a) Contribute to revealing the truth about the process of victimization and the serious violations of human rights and international humanitarian law.

b) Provide victims with an explanation of the factors, circumstances and peope responsible for the acts of victimization.

c) Help realize the right of the victims of the conflict to truth, justice, reparation and guarantees of non-repetition.

d) Recommend and promote structural and institutional reforms, needed to prevent future repetition of human rights violations and violations of international humanitarian law.

e) Contribute to the necessary process of national reconciliation, derived from the final agreement. The parties will jointly design issues related to the mandate, integration, operation and duration of the work of the Commission. Its work should be based primarily on the voices and testimonies of victims, notwithstanding all sources that are deemed necessary to clarify the truth. Its final report will be binding on the parties.

As part of the process of clarifying the truth, the "Center of Historical Memory of social and popular movements and organizations" shall be created to recover the historical memory of the dispossessed. This Center will have a chapter of reconstruction of historical memory of insurgent organizations. The Center's work will be a reference for the Museum of social and popular movements and organizations.
